H. S. Madaan, J. (Oral) After arguing for some time, learned counsel for the petitioners states that he be permitted to withdraw the present petition, though a direction be issued to the Court of Additional Sessions Judge, Pathankot, before whom appeal against judgment of acquittal passed by the trial Court is pending, to take into consideration the pleas to be raised by the petitioners with regard to maintainability of the appeal.

The petition is dismissed as withdrawn with the observation that all pleas regarding maintainability of the appeal being raised by the petitioners, be considered by the Appellate Court without being prejudiced by the impugned order passed it.
