IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CRM M-46499 of 2017 Date of decision : 28.03.2018 Dalip Kumar Verma & ors.

....Petitioners V/s State of Haryana ....Respondent BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Aditya Sanghi, Advocate for the petitioners. Mr. Chetan Sharma, AAG Haryana.

Mr. G.S. Gopera, Advocate for the complainant. RAJAN GUPTA J.

This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioners vide FIR No. 8 dated 07.01.2017 under sections 406, 420, 120B, 201 IPC at Police Station Chandimandir district Panchkula.

Petitioners are stated to be in custody for considerable period. It has been urged before the court that dispute between complainant and petitioners is primarily civil in nature. Conclusion of proceedings may take long time to conclude. Besides, petitioners have been granted the concession of bail in other cases exactly similar in nature. Thus, they deserve to be enlarged on bail.

Aforesaid contentions remain uncontroverted.

Keeping in view the contentions made before this court and the period of incarceration, I am of the considered view that no useful purpose would be served by detaining the petitioners in custody any longer. Ajay Kumar 2018.03.28 17:11 I attest to the accuracy and authenticity of this document

CRM M-46499 of 2017 Accordingly, petition is allowed and petitioners are directed to be enlarged on bail to the satisfaction of Trial court/Duty Magistrate subject to such terms and condition(s) as it may deem fit to impose. March 28, 2018 (RAJAN GUPTA) Ajay JUDGE Whether speaking/reasoned:
