Manju v. Asha Malik
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH COCP No.1416 of 2021 (O&M) Date of decision: 23.01.2023 Manju ....Petitioner
Versus
Asha Malik ....Respondent CORAM: HON'BLE MR. JUSTICE ARVIND SINGH SANGWAN
Present:
Mr. S.K. Goyat, Advocate for the petitioner.
Mr. Manish Dadwal, AAG, Haryana.
ARVIND SINGH SANGWAN J. (Oral) The petitioner alleges violation of the order dated 12.10.2020 vide which it was directed that status quo with regard to the services of the petitioner shall be maintained. Counsel for the petitioner submits that on that day, the petitioner was working as Extension Lecturer in Commerce Department, Government College, Meham and thereafter, she has been adjusted.
Since the status quo order is only with regard to the services i.e. against termination and not against the transfer, the transfer being a normal course of government employee for which he/she has no right to claim a particular place of posting. As the petitioner is adjusted from one College to other College and she is still continuing in services, there is no violation of the order of status quo regarding the services. Accordingly, the present petition is disposed of having been rendered infructuous.
However, liberty is granted to the petitioner to avail the alternative remedy in accordance with law, if so advised. (ARVIND SINGH SANGWAN) JUDGE 23.01.2023 yakub Whether speaking/reasoned:
