This is a petition filed under section 439 Cr.P.C. with a prayer for release of the petitioner on bail in a case registered vide F.I.R. No.108 dated 4.4.2014 under Section 20 of the N.D.P.S. Act at Police Station Sadar, Sonepat. The petitioner was found having in his custody 7.5 kgs. of Charas while he was standing near an eatery (Dhaba). Cr.M.No.6360 of 2015 -2custody since April, 2014 and the trial is in progress. Besides, it is contended that the petitioner has no previous conviction or any case registered against him either under the N.D.P.S. Act or otherwise.

Learned counsel for the State concedes that the petitioner is in custody since April, 2014 and that the trial is in progress with as many as six witnesses having been examined out of total fourteen witnesses. On due consideration of the matter and noticing the fact that it is not disputed that the petitioner is not having any other criminal antecedents, and also the fact that the petitioner is in custody since April, 2014, I deem it appropriate to accept the petition and direct that the petitioner be released on bail subject to his furnishing heavy surety to the satisfaction of the trial Court.
