**** HARNARESH SINGH GILL,J.(Oral) Through this petition, the petitioner seeks issuance of a writ in the nature of certiorari quashing the impugned order dated 05.08.2020 (Annexure P-8), vide which transfer of respondent No.6 to GPS Moginand, Panchkula and issuance of charge-sheet against him, have been cancelled.

Short reply filed on behalf of respondent No.6, in the Court, is taken on record.

At the outset, learned State counsel submits that respondent No.6 had already been transferred to GPS Moginand, Panchkula and a charge-sheet had also been issued against him, in which a detailed inquiry was conducted.

Learned counsel for respondent No.6 submits that in the aforesaid charge-sheet, respondent No.6 has been inflicted a punishment AMAN JAIN 2023.02.27 15:03 I attest to the accuracy and integrity of this document

CWP-11850-2020 (O&M) -2of censure and, therefore, the petitioner has no longer any cause of action to maintain the present petition.

Learned counsel for the petitioner submits that the petitioner has also been issued a warning notice to be careful in future and not to make any false complaint against anyone and that, though he is not aware about the conclusion of the inquiry proceedings against respondent No.6, yet the petitioner was never associated in the said inquiry proceedings. Be that as it may, the fact remains that respondent No.6 stands transferred to GPS Moginand, Panchkula and the inquiry proceedings pursuant to the issuance of the charge-sheet have already been concluded, there exists no cause of action in the present petition. Dismissed.
