The petitioner has filed the instant petition under Article 226 of the Constitution of India, seeking issuance of a writ of certiorari to set aside the impugned order dated 02.09.2025 (Annexure P-16) being passed without following the Rule 7.3 of the Punjab Civil Services Rules, Volume-I. Further, seeking issuance of a writ of mandamus directing the respondents to grant correct pay scale to the petitioner after giving increment for the years 2016 & 2017 along with the ACP on completing 09 years of service along with interest @ 18% per annum from the date of benefit accrued and to pay the complete salary to the petitioner for the period of suspension w.e.f. 23.08.2016 to 31.12.2017 after considering the suspension period as a period spent on duty for all purposes.

On receipt of advance copy of the petition, Mr. Kanav Singla, A.A.G., Punjab has put in appearance on behalf of the respondents-State and on instructions, submits that the impugned order dated 02.09.2025 (Annexure P-16) shall be treated as withdrawn and VINOD KOTHIYAL 2026.04.17 16:39 I attest to the accuracy and authenticity of this document

Learned counsel for the petitioner submits that the petitioner may also be given liberty to submit a detailed representation to the respondents.

In view of the above, the instant petition is disposed of with liberty to the petitioner to submit a detailed representation to the respondents within a period of two weeks and the respondents shall pass a fresh order within a period of three months thereafter after affording an opportunity of hearing to the petitioner.
