ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for quashing of FIR No.125 dated 11.06.2017 registered under Sections 379-A, 420, 395, 397 IPC and 25 of the Arms Act at Police Station Nagina, District Nuh and all other subsequent proceedings arising therefrom on the basis of the compromise.
A perusal of the office report of the last 03 dates show that the notice issued to the complainant/respondent Nos.2 and 3 have not been received back served or otherwise and in the last report, it is stated that they are not residing at the given address on the dasti notice taken by the petitioners.
In view of the above, it cannot be ascertain that there is a valid compromise between the parties, at this stage. Accordingly, this petition is disposed of having been rendered infructuous. However, liberty is granted to the petitioners to file afresh petition, if the complainant, still acknowledges the factum of compromise.
