Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Sahib Singh, who has been booked for having committed the offences punishable under Sections 307, 323 and 324, IPC, in a case arising out of FIR No.213, dated 18.10.2013, registered at Police Station, Guruharsahai, District Ferozepur.

Learned counsel contends that as per prosecution version, the petitioner was driving Scorpio vehicle at the time of hitting of the motorcycle being driven by the informant; the ingredients of Section 307, IPC, are not attracted; the petitioner did join the investigation during the pendency of the bail petition before the Court of Session and on several dates, the Investigating Officer did not produce the police file before the said Court and as such, the petitioner withdrew his petition from the said court and SEEMA RANI 2015.02.27 13:54 I attest to the accuracy and authenticity of this document Chandigarh

Criminal Misc.No.M-6367 of 2015 [2] when he filed second petition for grant of anticipatory bail, the same was dismissed.

I have heard the learned counsel for the petitioner and with his able assistance gone through the material available on record.

As per the allegations, on 01.10.2013 at about 7:30 p.m the informant, Karaj Singh was proceeding towards village Mehmood Khaneke on his motorcycle bearing No.PB-61A-8717 and had reached just ahead of brick kiln in the area of Pir Bakhsh Chauhan then his motorcycle was hit from the rear side by a Scorpio vehicle driven by the petitioner with an intention to kill him. The informant fell down on the ground and received the injuries on his right leg and right arm. The occurrence was witnessed by Nirmal Singh and Ranjit Singh. Earlier the petitioner had filed the petition for grant of pre-arrest bail before the Court of Session which was dismissed as withdrawn while the second petition was dismissed by the same court on 12.02.2015. There are serious allegations against the petitioner and he is avoiding his arrest for the last more than 01 year and 04 months. No ground for grant of anticipatory bail to the petitioner is made out.

Dismissed.
