The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.925 dated 20.10.2016 registered for the offences under Sections 324, 506 and 34 IPC, (Sections 326 and 307 IPC, which were added later on) and Section 25 of the Arms Act at Police Station Sadder, Hisar, District Hisar. Notice of motion was issued in this case.

Mr. Sukhdeep Parmar, learned Deputy Advocate General, Haryana has appeared on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned State counsel and have gone through the record.

Cr. Misc. No.M-46526 of 2017 [2] As per the FIR, the present petitioner is named in the FIR. As per the allegations in FIR, Satish alias Chingaponi caused the injury with knife in the left abdomen of complainant-Surender which injury has been declared dangerous to life.

Keeping in view the facts and circumstances of the present case, nature and gravity of the offences and the fact that the petitioner is the main accused, who caused the injury dangerous to life, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in this petition, the same is dismissed.

The petitioner is on interim bail. He is directed to surrender before the trial Court within 7 days from today. The trial Court is directed to complete the trial at the earliest by giving short adjournments, even day to day adjournments, if required. The Investigating Officer and SHO of concerned Police Station are directed to produce the remaining witnesses before the trial Court on the next two dates. The Superintendent of Police, Hisar will personally look into the matter that all the witnesses are produced before the Court expeditiously as ordered above. The trial Court will take necessary steps to take the petitioner in custody. August 13, 2018.
