(Oral) The allegations against petitioner Ajay in this regular bail application are that on 6.9.2014, he along with his co-accused non-applicant while going on a motorcycle fired single fire from his .315 country made pistol in the area of Brahmanwas towards complainant Parveen Hooda. It is the contention of the counsel for the petitioner that it is a non-injury case as has been conceded readily by the learned State counsel. Keeping in view, as is argued, that the petitioner is in custody since 6.9.2014 and that the trial is not likely to be concluded in near future, no useful purpose will be served by retaining the petitioner in jail, as he has already undergone substantial period in custody. Accordingly, he is ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Rohtak.
