(ORAL) Through this petition under Section 482 Cr.P.C., prayer has been made for quashing FIR No. 119 dated 19.06.2010 (Annexure P-1) registered under Sections 323, 324, 326, 148, 149, 341 and 506 IPC at Police Station Adampur, Jalandhar and all the subsequent proceedings arising therefrom on the basis of compromise dated 16.10.2016 (Annexure P-2) effected in between the parties. As per report of the Judicial Magistrate Ist Class, Jalandhar, received vide letter No. 7 dated 11.01.2018, duly forwarded by the learned District and Sessions Judge, Jalandhar, vide letter No. 120 G/JRK dated 12.01.2018, none of the accused appeared before her for recording their statements qua compromise, in compliance to the order dated RISHU KATARIA 2018.11.15 12:05 I attest to the accuracy and integrity of this document
CRM-M-46558-2018 -207.12.2017. She further reported that since, none of the accused has appeared, therefore, veracity of compromise cannot be ascertained. In view of the above, the instant petition is liable to be dismissed for want of prosecution.
However, at this stage, learned counsel for the petitioners submits that he may be permitted to withdraw the instant petition. Ordered accordingly.
