The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.217 dated 29.8.2018 registered for the offences under Sections 364-A, 511, 323, 506 and 34 IPC at Police Station Sadar Ferozepur, District Ferozepur.
Notice of motion has been issued in this case. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. As per the FIR, complainant-Baljinder Singh was going from the college to his home on 28.8.2018 on his motorcycle, then a grey colour Swift car was stopped and two young boys pulled him from the motorcycle and threw in the vehicle. Later on, on seeing two motorcycles coming from the front side, the complainant shown courage and pushed one person, who was sitting near him and the window of the vehicle opened and he and the said person fell down outside and then some other person came there etc. The present petitioner is nominated in this case being involved in the commission of the offence. Keeping in view the nature and gravity of the offence, he is required for custodial interrogation, hence, I do not find it a fit case where the petitioner is entitled for the grant of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
