(ORAL) This petition under Section 438 Cr.P.C. has been filed by the petitioner seeking anticipatory bail in FIR No. 116 dated 24.08.2014 registered under Section 328 of the Indian Penal Code (IPC) and Section 66-A of Information Technology Act, 2000 (for short 'the Act') at Police Station Division No. 5, Jalandhar.
At the outset, learned counsel for the petitioner submits that Section 66-A of the Act has been struck down by the Hon'ble Supreme Court in its entirety.
On instructions from Inspector Joginder Singh, learned State counsel submits that on investigation of the FIR, the petitioner has been found innocent.
In view of the above, the instant petition has become infructuous and is disposed of as such.
