Prayer in the present petition is for grant of regular bail to the petitioner Kuljit Singh s/o Amar Singh, who has been booked for having committed an offence under Sections 406 and 420 IPC in a case arising out of FIR No.119 dated 22.5.2014, registered at Police Station Tanda, District Hoshiarpur.
Learned counsel for the petitioner contends that as per the allegations levelled in the FIR, an amount of Rs.3,00,000/- was taken by the petitioner from the complainant Ajit Singh for sending his son Maninder Singh to abroad. Learned counsel for the petitioner further states that the petitioner is behind the bars for approximately 2-1⁄2 months. Crl. Misc. No. M-6466 of 2015 -2any other case. The offence punishable under Sections 406 and 420 IPC is triable by learned Judicial Magistrate 1st Class. Learned counsel for the petitioner further states that in order to establish his bona-fide, he is ready to deposit an amount of Rs.1,50,000/- with the trial Court within two weeks.
Learned State counsel on instructions from HC Kuldeep Singh has not controverted these factual aspects. After hearing learned counsel for the parties and going through the contents of the petition, the same is allowed and the petitioner Kuljit Singh s/o Amar Singh, resident of Amar Timber Store, Darapur Road, Tanda, District Hoshiarpur, is ordered to be released on bail during the pendency of the trial in the present case subject to his furnishing bonds in the sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Hoshiarpur. Further in order to establish his bona-fide, the petitioner shall deposit an amount of Rs.1,50,000/- with the trial Court, which would be subject to the outcome of the decision pending before the trial Court. Learned trial Court is further directed to deposit the amount in a fixed deposit fetching the maximum interest.
