Petitioner has not been able to comply with the directions dated 15.2.2016. In order to show the bona fide intention to comply with the order, a bank draft of Rs.50,000/- in the name of complainant has been offered.

I am satisfied that the petitioner bona fide intends to settle the matter which is permissible as per the judgment in Damodar S. Prabhu Vs.Sayed Babalal H. 2010 (2) RCR (Crl.) 851. This petition is disposed of with a direction that the petitioner will appear before the trial Court on 2.4.2016 with bank draft of Rs.50,000/- offered today and along with another bank draft of Rs.60,000/- and Rs.10,000/- as additional amount which would be cost of unnecessary harassment caused to the complainant. CRM-M-5312-2016 (O&M) submission of bank drafts as stated above i.e. Bank drafts worth total Rs.1,20,000/-, he would be released on bail to the satisfaction of the trial Court. It will be open to the complainant to accept the said amount along with other amount as per judgment in Damodar S. Prabhu (supra) and compound the matter. It is made clear that in case the order passed today is not complied with, this petition will be deemed to have been dismissed.

It is observed that if for any reason, the complainant does not appear on 2.4.2016, the trial Court shall release the petitioner on bail on his furnishing bail bonds/surety bonds to its satisfaction and issue notice to the complainant for accepting the amount offered by the petitioner in the shape of bank drafts. A copy of the order be sent to respondent No.2, Jai Parkash Garg, as well as to his counsel Mr.Sanjay Aggarwal, Advocate, Ambala City, by the Registry.
