In the instant civil writ petition under Articles 226/227 of the Constitution of India, prayer has been made for issuance of a writ in the nature of Certitorari for quashing impugned charge-sheet dated 17.03.2020 (Annexure P-6).

Mr. TPS Chawla, DAG, Punjab accepts notice on behalf of respondents.

Learned counsel for the petitioner contends that the purpose of instant writ petition would be achieved, if, respondents are directed to decide representation dated 11.06.2020 (Annexure P-5), moved by the RISHU KATARIA 2020.08.17 15:06 I attest to the accuracy and integrity of this document

In view of the above, instant civil writ petition is disposed of with a direction to the respondents to look into the matter and decide representation Annexure P-5, moved by the petitioner, in accordance with law, by passing a speaking order and after affording an opportunity of hearing to him, within a period of two months from the date of receipt of certified copy of this order. The instant writ petition be also made as part and parcel of the said representation.

It is, however, made clear that till the decision of representation Annexure P-5 moved by the petitioner, charge-sheet or enquiry proceedings against the petitioner shall remain stayed.
