This is a petition for grant of regular bail to the petitioner in case FIR No. 95 dated 3.9.2014, registered under Section 376 IPC, at Police Station Mantiana, District Hoshiarpur. On the last date of hearing, the matter was adjourned so that the prosecutrix could be cross-examined. Learned Additional Advocate General, on instructions of Assistant Sub Inspector Bhupinder Singh, submits that the prosecutrix has been cross-examined now.

Learned counsel for the petitioner submits that the petitioner has been in custody for about one year and now the prosecutrix has been cross-examined and there is no hurdle to grant DEEPAK KUMAR BHARDWAJ 2015.08.28 17:23 I attest to the accuracy and authenticity of this document

Criminal Misc. No. M-6480 of 2015 him bail. In this connection, on 25.5.2015, the following order was passed:- "On instructions from ASI Bhupinder Singh, learned State counsel submits that the cross-examination of prosecutrix has not been recorded so far.

Learned counsel for the petitioner requests for an adjournment, adjourned to 27.07.2015."

In these circumstances, I do not deem it appropriate to deny the concession of bail to the petitioner. Thus, the present petition is allowed and the petitioner is released on regular bail to the satisfaction of the trial Court/Duty Magistrate. (Ajay Tewari) Judge August 27, 2015 "DK"
