Prayer in this petition is for grant of anticipatory bail to the petitioners in FIR No.51 dated 19.12.2016 under Sections 498A/323/34 IPC registered at Police Bhiani Mian Khan, District Gurdaspur. Petitioner No.1 is the mother-in-law and petitioner No.2 is the unmarried brother-in-law (Devar) of respondent No.2.

It is contended that the abovesaid FIR has been registered by the complainant in connivance with her husband who is none other than the other son of petitioner No.1 and brother of petitioner No.2. The complainant and her husband in a bid to grab the commercial shop as well as six marlas of land Omkar Singh 2017.04.24 17:51 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-4664 of 2017 [2] situated in village Naushehra have lodged the present FIR. The petitioners have joined investigation pursuant to interim order dated 14.02.2017 passed by this Court therefore, this petition be allowed. Learned counsel for the State, on instructions from ASI Avtar Singh, verifies that the petitioners have since joined investigation. It is not denied that respondent No.2 is residing alongwith her husband Hariday Pal Singh. The complainant's husband is not an accused in the present case. There are no allegations on behalf of the State that the petitioners are likely to abscond or that they are likely to dissuade the witnesses from deposing true facts in the Court, if released on bail. Keeping in view the facts and circumstances as above but without commenting upon or expressing any opinion on the merits of the case, this petition is allowed. Consequently, order dated 14.02.2017 is made absolute. ( LISA GILL ) April 24 , 2017.
