(Oral) The petitioner has filed this petition under Articles 226/227 of the Constitution of India, praying for issuance of a writ in the nature of certiorari for quashing the communication dated 24.05.2022 (Annexure P-6) vide which request of the petitioner was rejected for availing the chance of physical fitness test for the post of fireman on reserve day; along with certain other prayers.
Notice of motion.
Mr. Mayank Sharma, Advocate, who is present in court, accepts notice on behalf of respondent No.1 and submitted that the process of physical fitness test is already over, therefore, the petitioner cannot be subjected to the physical fitness test any more, by organizing the paraphernalia only for the petitioner.
The ground taken by respondent No.1 is found to be genuine. Since the process of the physical fitness test is already over, RAJ KUMAR 2022.06.02 10:37 I attest to the accuracy and integrity of this document
CWP No.12724 of 2022 -2therefore, it would not be appropriate to reopen everything just to ensure the physical fitness test of the petitioner.
In view of the above, finding no merit in the present petition the same is dismissed.
