(Oral) In the present writ petition, the petitioner is praying for issuance of a writ in the nature of certiorari for quashing the order dated 26.12.2025 (Annexure P-1), vide which the petitioner has been placed under suspension. The petitioner has also challenged the letter dated 20.03.2026 (Annexure P-4), vide which the petitioner has not been deputed to the Upper School Course on the ground that he is unwilling to undergo the said course.

Learned counsel appearing for the petitioner submits that an order of suspension can only be passed where the respondents have taken a decision to initiate departmental proceedings or have issued a charge-sheet. He submits that that, till date, to the best of his knowledge, the respondents have neither contemplated initiation of -1-

departmental proceedings nor issued any charge-sheet. As such, the order of suspension dated 26.12.2025 (Annexure P-1) is unsustainable in the eyes of law.

Learned counsel appearing for the petitioner further submits that the letter dated 20.03.2026 (Annexure P-4), issued by respondent No.2, whereby the petitioner has been denied participation in the Upper School Course by the Competent Authority, on the premise that the petitioner is unwilling to participate in the said course. He submits that the petitioner has never expressed any unwillingness to participate in the Upper School Course. As such, the letter dated 20.03.2026 (Annexure P-4), insofar as it relates to the petitioner, is liable to be set aside.

Learned counsel appearing for the petitioner, on instructions from the petitioner, submits that he will be satisfied, at this stage, if a direction is given to respondent No.2 to decide the representation dated 21.03.2026 (Annexure P-5) submitted by the petitioner in a time-bound manner.

Mr. Rohit Ahuja, Deputy Advocate General, Punjab, accepts notice on behalf of respondents and does not oppose the prayer made by learned counsel for the petitioner.

In view of the above and without commenting upon the merits of the case, the present petition is hereby disposed of with a direction to respondent No.2 to consider and decide the representation dated 21.03.2026 (Annexure P-5), submitted by the petitioner, in -2-

accordance with law, within a period of one month from the date of receipt of certified copy of this order.
