The prayer of the petitioner is for quashing the order dated 16.02.2018, Annexure P-9.

Learned counsel submits that the past service rendered by the petitioner in District Urban Development Agency at Sirsa, a Government agency, has not been counted towards pensionary benefits and denied via the impugned order.

Learned State counsel has made a reference to the short reply dated 13.12.2023 filed by the Director Department of Economic and Statistical Affairs, Haryana, relevant paras whereof read thus:

"4. That in accordance with the regulations specified in para 7 copy of the Memorandum (Annexure P-7) this option should indeed be exercised within a period of six months from the date of appointment. However, it is evident that the petitioner did not exercised this option within the stipulated time frame. 5.

That accordingly, based on the aforementioned circumstances and prevailing regulations, the benefit of past service cannot be granted to the petitioner without obtaining relaxation from the finance department. As a result, the case Raman Kumar 2024.07.31 12:08 I attest to the accuracy and integrity of this document

CWP-13265-2022 -2has been duly forwarded to the finance department for their consideration.

6. The respondents are committed to addressing the petitioner's concerns through the proper channels and in strict compliance with the relevant law and regulations. We eagerly await the response and decision of the finance department regarding the requested relaxation. Further the respondents are filing the short reply reserving the right to file detailed reply if need arises on directed by this Hon' Court."

On instructions, learned State counsel submits that a decision in this regard shall be taken within a period of 4 months, which satisfies learned counsel for the petitioner.
