The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking direction to respondents No.1 to 2 to decide his representation/legal notice dated 04.10.2021 (Annexure P-1) and pass speaking order in a time bound manner. He is further seeking direction to respondents to issue 'Red Card' in his name. 2.

The petitioner claims that he was displaced from Chakkar Ghat, Uttar Pradesh during anti-Sikh riots. He settled at Ajit Nagar, Batala, District Gurdaspur, Punjab in November' 1984. Punjab Government in December' 1985 launched a Relief and Resettlement scheme under the Department of Revenue. Affected Sikh Migrants were issued 'Red Card' for claiming benefits of resettlement scheme. Petitioner along with his family members applied for the same. Except the petitioner his family members were issued 'Red Card'. He preferred CWP-25145-2013 before this Court which was disposed of vide order dated 13.10.2014 with a direction to respondent to decide his representation within three months. Time and again he preferred RTI application along with legal notice but to no avail. He again approached this Court by way of CWP-11297-2022 which was withdrawn with liberty to file fresh with better particulars. This is third round of litigation.

Learned counsel for the petitioner submits that petitioner's claim was rejected on the ground that he has not produced documentary evidence to establish that he migrated to Punjab during anti-Sikh riots. He has now collected documents. The authorities may be directed to consider his documents.

Faced with this, learned State counsel submits that petitioner may be directed to appear before Deputy Commissioner, Gurdaspur along with all the documents available with him. The Deputy Commissioner would consider his claim in accordance with law and pass an appropriate order within three months from today.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the instant petition stands disposed of 7.
