The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of certiorari, quashing the impugned appointment order dated 19.08.2024 (Annexure P-1) of respondent No.4, who was appointed on compassionate basis under the Punjab Government Scheme for Compassionate Appointments, 2002 (as amended upto-date) (Annexue P-2), whereas clause 14 mandates that the compassionate appointee will maintain the dependents of the deceased employee, however, respondent No.4 after getting the compassionate appointment, not maintaining the petitioner-mother and rather has got a legal notice dated 26.09.2025 issued to vacate the government accommodation (Annexure P-4).

Learned counsel for the petitioner submits that respondent No.4, who has been appointed on compassionate ground, is not adhering to the undertaking as contemplated under Clause 14 of the Policy dated 21.11.2002 (Annexure P-2). He further submits that for redressal of her grievances, the petitioner has also served legal notice dated 12.02.2026 VINOD KOTHIYAL 2026.04.17 16:45 I attest to the accuracy and authenticity of this document

He further submits that at this stage, the petitioner would be satisfied, if appropriate directions are issued to the respondents to consider and decide the said legal notice, by passing a speaking order, in a time bound manner.

Notice of motion restricted to respondents No.1 to 3 only. 4.

Mr. Kanav Singla, A.A.G., Punjab, accepts notice on behalf of the respondents-State. He has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to consider and decide legal notice dated 12.02.2026 (Annexure P-5) submitted by the petitioner expeditiously, by passing a speaking order after affording an opportunity of hearing to the petitioner, preferably within a period of 02 months from the date of receipt of certified copy of this order. Further, the decision taken thereon shall be conveyed to the petitioner.
