R.P. Nagrath, J. (Oral) Petitioner seeks bail under Section 439 Cr.P.C. in FIR No. 167 dated 02.08.2014 for offences under Sections 21/29 of Narcotic Drugs and Psychotropic Substances Act, registered at Police Station Maqsudan, District Jalandhar.
Learned State counsel submits that recovery of 260 gms. of heroin was made from Jasmail Singh @ Danny. On interrogation of co-accused the name of petitioner cropped up but no recovery of contraband article was made from him.
The petitioner is in custody since 06.08.2014 and it will take sometime in conclusion of the trial.
In view of the above and without commenting on the merits of the case, the instant petition is allowed and the petitioner be admitted to bail on furnishing bail bonds to the satisfaction of the trial Court.
Allowed in the above terms.
