RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerResham Singh @ Reshi, has prayed for grant of regular bail in case FIR No. 75 dated 21.08.2018 registered under Section 22 of the NDPS Act (Section 29 of the NDPS Act, added later on) at Police Station Harike, District Tarn Taran.

According to the prosecution, 8500 intoxicant tablets containing salt Tramadol were recovered from the conscious possession of petitioner without any permit or licence, while intercepting him at Bus Stand, Harike.

Learned counsel inter alia contends that petitioners has been falsely implicated in this case. He is in custody since the date of his arrest. Conclusion of trial may take a long time. No useful purpose RISHU KATARIA 2018.11.02 18:05 I attest to the accuracy and integrity of this document

CRM-M-47712-2018 -2would be served by detaining him in jail. More so, co-accused of the petitioner, namely; Ram Nath Narang, has already been granted the concession of anticipatory bail by this Court vide order dated 05.10.2018 (Annexure P-3), passed in CRM-M-41178-2018. Thus, treating the case of the petitioner on the same parity, he may be granted the concession of regular bail.

On the other hand, learned State counsel vehemently opposed the above submission of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Resham Singh @ Reshi, is ordered to be released on bail pending trial, treating his case on the same parity as that of his co-accused, namely; Ram Nath Narang, on his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
