Petition under Section 438 of the Code of Criminal Procedure, 1973 has been filed for grant of pre-arrest bail to the petitioner in complaint bearing No.NACT-1246-2021 dated 20.12.2021, under Section 138 read with Section 142 of the Negotiable Instruments Act, 1881.

Allegations are that petitioner failed to discharge legal liability to the tune of Rs.1,00,000/- towards the complainant. 3.

Contends that petitioner was granted bail by learned trial Court and he had been regularly appearing. Further contended that on 08.02.2024, petitioner could not appear due to communication gap with his counsel and thereafter, he remained busy being a government employee. Again contends that petitioner is ready to join the proceedings, but he be protected.

Heard learned counsel for the petitioner and perused the paper-book.

Concededly, petitioner was granted bail by learned Judicial Magistrate First Class, Faridkot, but he evaded the proceeding without any valid cause and his bail was cancelled. 6.

Although, offence alleged against the petitioner is bailable, but he has deliberately evaded the process of law; therefore, this Court is not inclined to entertain the prayer. Consequently, there is no option except to dismiss the petition.

Ordered accordingly.

In case the petitioner surrenders before learned trial Court within 01 week from today, his regular bail application be considered expeditiously, in accordance with law.

The observations made above be not construed as an expression of opinion on merits of the case; rather confined only to decide the present bail matter.

Pending application(s), if any, shall also stand disposed off.
