*** H.S. Grewal, J. (Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in FIR No.28 dated 02.03.2025 under Section 16 of NDPS Act, 1985 registered at Police Station Koom Kalan, District Ludhiana.

   

   

 the petitioner had sown poppy plants and he does not own any land. He further contends that he is merely a vegetable vendor and the recovery effected is only of poppy plants and no pods have been recovered.

This Court, vide order dated 28.04.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

CRM-M-21216-2025 -25. In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 28.04.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
