Learned counsel for the petitioner has placed on record original receipt issued by the Judicial Magistrate 1st Class, Kapurthala regarding deposit of an amount of 1.50 lacs, and thus, it is accepted that in total a sum of 5.00 lacs stands deposited. It is argued by the learned State counsel that in all there are 9 accused and that proclamation proceedings are pending against 3 accused who are yet to be arrested, reflects that conclusion of trial will certainly take a long time and in view of the bona fide shown by the petitioner by depositing a sum of 5.00 lacs, however without adverting onto the merits of the case, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail subject to two sureties of heavy amount to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate.
The present petition stands disposed off accordingly.
