CM No.10725 of 2015 The application is allowed and the main case is taken on Board to today itself for final disposal.

Main case As similar matter was decided on 31.08.2009 by this court in CWP No.8173 of 2008 the operating portion of which is reproduced in para.6 of the judgment in the disposed of petition. The petitioner was coworker under the same management, the respondent, and similarly situated as in the matter.

CM Nos.10724-725 of 2015 in/and CWP No.5171 of 2007 -2counsel is accepted and the matter is remanded to the Labour Court for consideration of the case afresh in the light of the observations made in the judgment and order disposing of the aforesaid writ petition. Therefore, the case is remanded to the Labour Court in the same terms.

The matter being an old one, the Labour Court would make an endeavour to decide the remand proceedings expeditiously and preferably within six months.

With this, the petition stands disposed of.
