**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioner seeks pre-arrest bail in FIR No. 150 dated 20.10.2014 under Section 498-A (Section 406 IPC was added later on) registered at Police Station B Division, Amritsar. Notice of motion was issued and interim protection was granted.

Learned counsel for the petitioner submits that in compliance of the order passed by this Court, petitioner has joined the investigation and recovery of as many as 25 dowry articles was effected, list of which, was prepared by a police officer on 14.4.2015. He further submits that since the petitioner is no more required for the purpose of any further investigation, present petition may be allowed.

Criminal Misc. No. M-6719 of 2015 Learned counsel for the State submits that although recovery of 25 dowry articles has been effected, yet some more dowry articles are to be recovered.

Similarly, learned counsel for the complainant prays for dismissal of the present petition, while supporting the contentions raised by the learned counsel for the State.

Petitioner-husband and complainant-wife are present in the Court.

When the proposal for an amicable settlement was put to the complainant-wife, she expressed her inability in this regard, at this stage. However, still leaving the scope of an amicable settlement open, this Court is of the considered opinion that the petitioner is entitled for the concession of anticipatory bail. Accordingly, order dated 2.3.2015 passed by this Court is hereby made absolute, however, subject to the conditions envisaged under Section 438 (2) Cr.P.C.

Disposed of, accordingly.
