***** M.M.S.BEDI, J.(Oral) The petitioners are parents and brother of Kirti wife of complainant-Rakesh. As per the allegations of the prosecution, Kirti wife of the complainant had illicit relations with one Neeraj, and despite repeated requests of the complainant she did not mend her ways. So far as the petitioners are concerned, the allegations against them are that they being related to Kirti, used to support her and threatened the complainant and his father as a result of which, feeling humiliated, father of the complainant committed suicide by hanging himself.

Without expression of any opinion on merits, it is sufficient to observe that the allegation of abetment levelled against the petitioners being parents and brother of Kirti regarding suicide of father of the complainant would certainly be a debatable issue. The authenticity of the suicide note is also not confirmed till date.

Taking into consideration the fact that the petitioners have been SUNIL DEVI 2016.03.21 14:48 I attest to the accuracy and integrity of this document

CRM-M-5568-2016 -2in custody since October 2015, challan having been presented without report regarding authenticity of the contents of suicide note, the petitioners can be granted the concession of bail.

Petition is allowed.

Petitioners are ordered to be released on bail on their furnishing bail bonds/surety bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Rohtak.
