(Oral) This is a petition filed for anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 in case bearing FIR No.02 dated 03.01.2025 under Section 318(4) and 61(2) of Bharatiya Nayaya Sanhita (BNS), 2023 and Sections 336(2), 338, 336(3), 340(20) of BNS added later on registered at Police Station City Phagwara, District Kapurthala. The case of the prosecution is that co-accused of the petitioner was named in the FIR for allegedly having embezzled an amount of Rs.12.38 lakhs from the bank account of the customer while working as an employee in the said Bank. During interrogation in custody, he named one Narinder Kumar and Kamaldeep Singh and further, the said Kamaldeep Singh during his interrogation, has named the present petitioner. It is stated that the petitioner has neither received any amount in his account nor was connected in any activity where he could have any part of the embezzled amount. 3.
Learned counsel for the petitioner contends that the petitioner has been named in the present FIR on the basis of disclosure statement made on Sonia Puri 2025.07.14 16:57 I attest to the accuracy and integrity of this document
CRM-M-21461-2025 -2behalf of his co-accused and there is no other evidence to connect him with the alleged offence.

This Court, vide order dated 01.05.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Section 438(2) Cr.P.C.

Learned State counsel on instructions states that the petitioner has joined the investigation and is not required for custodial interrogation. 7.
In view of the submissions of learned counsel for the petitioner especially when the petitioner has cooperated with the Investigating Officer, the order dated 01.05.2025 granting interim bail to the petitioner is made absolute. 8.
However, the petitioner shall abide by the conditions stipulated under Section 482, BNS. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
