M.M.S. BEDI, J (ORAL) Counsel for the petitioner submits that on account of only three witnesses out of twelve having been examined despite a direction dated 19.8.2014, the petitioner may be granted concession of regular bail. The petitioner was allegedly found in possession of 70 gms. of intoxicating powder which on examination was found to contain diphenoxylate hydrochloride for which the commercial quantity prescribed is 50 gms.

Taking into consideration the fact that the petitioner has been in custody w.e.f. 16.8.2013 and only three witnesses out of twelve witnesses having been examined, it is ordered that in case the prosecution agency is not able to produce the entire evidence within three months after the next date of hearing fixed before the trial Court, the trial Court shall release the petitioner on bail on his furnishing bail bonds/surety bonds to its satisfaction. Disposed of with the aforesaid directions.
