Mr.Kirat Singh Sidhu,DAG Punjab assisted by ASI Surinder Singh Jaswant Singh,J(Oral) Accused-petitioner Gurjant Singh is seeking grant of anticipatory bail in case FIR No.258 dated 20.11.2013 under Sections 307,115,120-B IPC and Sections 25/54/59 of the Arms Act,PS Division NO.7,Jalandhar,Distt.Jalandhar.
Petitioner was enlarged on bail and for his solitary absence on 1.12.2015, his bail bonds were cancelled and NBWs issued. It was submitted that non-appearance of the petitioner was on account of bona fide reasons and the intent was not to evade the process of law. Vide order dated 16.2.2016 while issuing notice of motion it was directed that in case the petitioner duly appears before the trial Court on the date already fixed i.e. 23.2.2016, he would be entitled to interim bail subject to satisfaction of the trial Court.
At the time of hearing today,learned counsel states that in compliance of the said order, petitioner surrendered before the trial court on RAJINDER PRASHAD JOSHI 2016.05.20 11:32 I attest to the accuracy and integrity of this document
CRM-M 5594/2016 23.2.2016 and was released on interim bail.
Learned State counsel on instructions is unable to refute the said factual position.
In view of the above interim bail granted by the trial court, pursuant to the order dated 16.2.2016, is made absolute. Disposed of.
