(Oral) By way of instant petition, petitioners have approached this Court for issuance of writ in the nature of mandamus for seeking directions to respondents No.2 and 3 for protection of lives and liberty of petitioners from the hands of private respondents No. 4 & 5. Order of notice of motion was issued on 02.06.2022 and thereafter, there was no representation on behalf of the petitioners. Order dated 28.02.2023 says as under:
"Petitioners have sought the issuance of directions to official respondents No. 2 and 3 for protecting their life and liberty, at the behest of respondents No. 4 & 5 and other relatives.
As per the contents of the petition, petitioner No.1 Rajpal Kaur is married to respondent No.4-Balkar and, thus, it appears to be matrimonial dispute.
Notice of motion was issued by this Court on 02.06.2022. On the last date of hearing i.e. 01.09.2022, there was no representation from the side of the petitioner. Today also, there KAVITA NAIN 2023.03.03 14:31 I attest to the accuracy and integrity of this document order/judgment
CRWP-5414-2022 - 2 - is no representation on behalf of the petitioner. In the interest of justice, adjourned to 03.03.2023. Registry is directed to inform the counsel for the petitioner regarding the next date of hearing." Today, on the very outset, counsel for the petitioners seeks withdrawal of the present petition.
