Apparently, the petitioner has already been declared as a proclaimed offender. Faced with this situation, counsel for the petitioner has made statement withdrawing the present petitioner, however, reserving the right of the petitioner to first getting the order of declaring proclaimed offender set aside and thereafter to seek appropriate remedy under section 438 Cr.P.C. Allowed to do so.

Dismissed as withdrawn with the liberty as aforesaid. Records be sent back.
