(ORAL) Through this petition under Section 438 Cr.P.C., prayer has been made for issuance of a direction to the arresting officer to release the petitioner forthwith in the event of his arrest in case FIR No. 36 dated 04.05.2017, under Section 22 of the NDPS Act at Police Station Maloud, Police District Khanna, District Ludhiana.

Briefly, the petitioner who was on bail, during trial absented on 04.10.2018. Consequently, he was ordered to be summoned through nonbailable warrants by cancelling his bail and surety bonds. Learned counsel inter alia contends that absence of the petitioner on 04.10.2018, was not intentional or deliberate, rather was on account of break down of his car, due to which he could not reach Court in time.

Perusal of the impugned order shows that the petitioner has misused the concession of bail for the second time. In view of the above, but without commenting upon the merits RISHU KATARIA 2018.10.31 11:04 I attest to the accuracy and integrity of this document
