SANDHAWALIA, J.(Oral) The petitioner, by filing the present civil writ petition under Articles 226/227 of the Constitution of India, seeks directions for consideration for promotion to the post of Head Master of High School w.e.f. the date when several juniors have been promoted vide order dated 15.03.2021 (Annexure P-10).

It is the case of the petitioner that his seniority number is 1408 in Elementary School Head Master cadre and his juniors bearing seniority Nos. 1410 and 1412 namely Kapoor Singh and Sukh Lal have been promoted and petitioner has been ignored. He, thus, submits that his representation dated 12.04.2021 (Annexure P-9), which finds mention of the necessary facts, be considered and a decision be taken within a fixed time frame.

Keeping in view the above, this Court does not deem it appropriate to call the respondents to file reply as it will only delay in decision making process.

Without commenting on the merits of the case and entitlement of the petitioner, this petition is disposed of with directions to the respondents to consider the representation dated 12.04.2021 (Annexure P-9) within a period of two months from the date of receipt of certified copy of this order.

In case, the petitioner is entitled for the promotion, necessary benefits be granted to him from the date, his juniors were granted the same. In case, there is any legal impediment as such, a reasoned order be passed and communicated to the petitioner.
