The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.197 dated 3.12.2014 registered for the offence under Section 409 IPC at Police Station Nathana, District Bathinda.

I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that the FIR in the present case has been registered on the application of Assistant Registrar, Cooperative Societies, Bathinda to the Senior Superintendent of Police, Bathinda. As per prosecution version, Balwinder Singh-present petitioner was Secretary of the Gobindpura Multipurpose Cooperative Agriculture Service Society Limited, Gobindpura. Cr. Misc. No.M-681 of 2015 [2] him is that he had taken `79,01,945/- from the members, but has not deposited the same and has embezzled the same. Keeping in view the facts and circumstances of the present case and the allegation against the present petitioner, nature and gravity of the offence and in view of the fact that the petitioner is required for custodial interrogation, I do not find it a fit case where the present petitioner is entitled to the benefit of anticipatory bail. Therefore, finding no merit in this petition, the same is dismissed.
