Learned State counsel has informed that petitioners 1 and 4 had been granted the concession of interim bail and that they have joined the investigation.
Heard.
During the course of arguments, counsel for the petitioners has brought to the notice of the court that petitioner No.3 Jobhanpreet Singh had also received a grievous injury on the right side of parietal bone, which is attributed to Multan Pal. Counsel for the petitioners is not aware whether Multan Pal has been granted the concession of bail in the cross version case. Since the injury on the person of petitioner No.3 Jobhanpreet Singh is not explained and it is a case of cross version, petitioners 1,3 and 4 can be granted the concession of pre-arrest bail. The petition is allowed qua petitioners 1,3 and 4 i.e. Shamsher Singh, Jobhanpreet Singh and Kulbir Singh @ Bagga, respectively.
It is ordered that in case of their arrest , they will be released on bail to the satisfaction of the arresting officer subject to the condition that they will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. However, petition qua petitioner No.2 Lakbir Singh is dismissed. Petitioners 1,3 and 4 will not commit the similar offence, of which they are accused of. In case of petitioners 1,3 and 4 not joining investigation, it will be open to the prosecution agency to seek cancellation of bail by moving an application. April 1 ,2016 ( M.M.S.
