Present petition under Section 439 Cr.P.C. for seeking regular bail to the petitioner(s) in case FIR No. 81 dated 6.7.2002, registered under Section(s) 15 of the Narcotic Drugs & Psychotropic Substances Act, 1985 at Police Station Harike, District Tarn Taran.

Learned counsel for the petitioner contended that petitioner is in custody since 13.11.2013 and his co-accused have already been acquitted of the charges. Learned counsel also contended that trial has already been completed; even arguments have been heard after conclusion of the defence evidence and next date fixed is 11.1.2018 before the learned trial Judge. Thus, prayer has been made to accept the present petition and to release the petitioner on regular bail.

Criminal Misc. No. M-46967 of 2017 petition on the ground that previous conduct of the petitioner does not make out a case of his release on regular bail; he misused the process of law and remained away from the Court of law for a period of about eight years. Learned State counsel further contended that petitioner was declared proclaimed offender and trial has almost completed. Having considered the above facts, present petition stands dismissed. However, the learned trial Judge is directed to expedite the trial and conclude the same expeditiously and preferably within a period of two months from today.
