(ORAL) Through this petition under Section 439 Cr.P.C., prayer has been made for grant of regular bail to petitioner-Gourav Kumar, in case FIR No. 10 dated 15.04.2018 registered under Sections 3, 4, 5 and 9 of the Official Secrets Act, 1923 (Section 201 IPC added later on) at Police Station Civil Lines Rohtak, District Rohtak.

At the outset, learned State counsel contends that the petitioner was sharing sensitive secret information with regard to base camp of defence of this country, through chatting to a lady, namely; Sonu Kaur @ Amita Amey, resident of Islamabad (Pakistan). Learned counsel for the petitioner refuting the above submissions of learned State counsel submits that the data which the petitioner had allegedly passed on to said lady of Islamabad, are five google photographs and nothing more, freely available on google browser. Considering the seriousness of allegations levelled against the petitioner, this Court is not inclined to grant regular bail to the petitioner. Dismissed.
