Petitioners have filed this petition under Section 438 of the Code of Criminal Procedure, 1973 seeking anticipatory bail in FIR No.260 dated 17.12.2014, under Sections 406 and 420 IPC, registered at Police Station Model Town, Hoshiarpur.
While issuing notice of motion, following order was passed by this court on 2.3.2015 :- "Counsel for the petitioner states that in view of affidavit dated 23.1.2015, the matter has been compromised between the parties.
Notice of motion for 19.3.2015.
In the meantime, in the event of arrest of the VIJAY ASIJA 2015.03.20 12:02 I attest to the accuracy and integrity of this document
Crl. Misc. No. M-6812 of 2015 -2petitioner, he shall be released on ad-interim bail subject to his furnishing personal bond in a sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the arresting officer. The petitioner shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C."
Learned State counsel, who is assisted by ASI Ashok Kumar, has stated that in terms of the above order the petitioners have joined investigation and are not required for further custodial interrogation. In view of the above, the present petition is allowed and interim directions issued by this Court vide order dated 2.3.2015 are made absolute.
However, the petitioners shall continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 438(2) Cr.P.C.
