Present petition under Section 439 Cr.P.C. for seeking regular bail to the petitioner(s) in case FIR No. 535 dated 20.10.2017, registered under Section(s) 408, 420, 468, 470, 120-B & 34 IPC at Police Station Civil Lines, District Amritsar.
Learned counsel for the petitioner contended that petitioner is in custody since 20.10.2017 and his co-accused, namely, Neeraj Khindri has been released on interim anticipatory bail by this Court vide order dated 13.11.2017 passed in CRM-M-42625-2017. Moreso, the entire amount has been recovered long back and decision of the case still to take some time. Thus, present petition be accepted and petitioner be released on regular bail. Criminal Misc. No. M-46984 of 2017 effected long back and co-accused, namely Neeraj Khindri has been released on interim bail by this Court.
Taking into consideration the fact that trial of the case still to take some more time; petitioner is in custody since 20.10.2017 and the amount, which is the subject matter of cheating and misappropriation, was recovered from the petitioner long back and no useful purpose will be served by detaining the petitioner in custody any further. Thus, present petition stands allowed and petitioner is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate, Amritsar.
