MANJARI NEHRU KAUL, J. (ORAL) Case has been called twice, however, even on second call, there is no representation on behalf of the petitioner as well as respondent No.2. On the last date as well, there had been no representation on behalf of the petitioner.

This Court vide order dated 12.05.2023, issued notice of motion, however, a perusal of orders passed thereafter reveal that either there had been no representation on behalf of the petitioner or a request for adjournment had been made.

It would be pertinent to reproduce the following orders of the previous dates of hearing i.e. 04.08.2023, 29.09.2023, 28.11.2023 and 08.01.2024 respectively:- "A request for adjournment has been made by learned counsel for the petitioner. On request, adjourned to 29.09.2023."

"In the interest of justice, adjourned to 28.11.2023." "Learned counsel for the petitioner prays for yet PUNEET SACHDEVA 2024.01.24 14:53 I attest to the accuracy and integrity of this document.

However, it is made clear that no further adjournment shall be granted under any circumstances and all the instructions may positively be received before the date fixed."

"Case called twice, however, even on second call nobody has entered appearance to make submissions on behalf of the parties.

A perusal of the previous orders reveals that repeated adjournments have been sought by the learned counsel for the petitioner after 04.08.2023.

Purely in the interest of justice, adjourned to 24.01.2024.

It is made clear that in case there is no representation on the date fixed, the instant petition shall be dismissed for non prosecution."

It is, thus, evident that the case is being adjourned time and again. It appears that the petitioner is not interested in pursuing the matter any further.

Dismissed for non-prosecution.
