RAMENDRA JAIN, J. (ORAL) Through instant petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.59 dated 05.04.2019 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances, Act, 1985 at Police Station Guhla (Kaithal).

According to the prosecution, on 05.04.2019 petitioner was apprehended with conscious possession of 940 grams of poppy husk and 3.425 kgs of poppy straw.

Learned counsel for the petitioner inter alia contends that petitioner is the first offender. He is in custody since 05.04.2019. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner any more in jail. On the other hand, learned State counsel vehemently opposed the grant of regular bail to the petitioner.
