Kusum Garg And Another v. Raj Kishan Alias Raja
IN THE HIGH COURT OF PUNJAB & HARYANA, CHANDIGARH
Sr. No.: 114 Civil Revision No.3246 of 2019 Date of Decision: May 16, 2019 Kusum Garg & another ..... PETITIONERS
VERSUS
Raj Kishan @ Raja ..... RESPONDENT . . .
CORAM:
HON'BLE MR. JUSTICE KULDIP SINGH . . .
PRESENT: - Mr. Govind Chauhan, Advocate, for the petitioners. . . .
Kuldip Singh, J (Oral) Heard.
The petitioner has impugned order dated 07.03.2019 passed by Civil Judge (Junior Division), Karnal, vide which an application for setting aside the exparte order dated 07.01.2019 was dismissed. It comes out that a suit for liquidated damages was filed against the petitioner. A perusal of the interim orders shows that present petitioners who are defendants in the said case have been proceeded against exparte on three occasions. On earlier two occasions, exparte proceedings were set aside. Now the Trial Court has taken the view that sufficient reason is not there to set aside the exparte proceedings for the third time.
