Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.92 dated 10.08.2015 under Sections 307 and 427 IPC, registered at Police Station Mamdot, District Ferozepur.

I have heard learned counsel for the petitioner and have gone through the record.

As per the prosecution version, on 09.08.2015 at about 7.30 P.M., when complainant Balwinder Singh was coming back on his motorcycle, then accused Jaspal Singh while driving the tractor came from behind and struck the same with the motorcycle of the complainant with the intention to kill him and due to this, complainant received injuries. It is in the order of learned Addl. Sessions Judge, Ferozepur, that this Jaspal Singh Vineet Gulati 2017.01.12 17:13 I attest to the accuracy and authenticity of this document Chandigarh is also known as Amarjit Singh, who is present petitioner.

CRM No.M-470 of 2017 -2The perusal of the record shows that interim bail was granted to the petitioner by learned Addl. Sessions Judge, Ferozepur vide order dated 18.03.2016 but the present petitioner did not join the investigation and has not complied with the directions of learned Addl. Sessions Judge, Ferozepur and vide order dated 29.04.2016, learned Addl. Sessions Judge, Ferozepur dismissed the anticipatory bail application.

As the present petitioner has not joined the investigation and has not complied with the directions of learned Addl. Sessions Judge, Ferozepur, his anticipatory bail application has been rightly dismissed by the trial Court. The conduct of the petitioner dis-entitles him from benefit of anticipatory bail.

Furthermore, the petitioner is the main accused in the present case, who as per prosecution version, hit the tractor with the motorcycle of the complainant with the intention to kill him. Therefore, finding no merit in the present petition, the same dismissed.
