Though service on respondent no. 2 is not complete, learned counsel submits that in view of judgment in Oriental Insurance Co. Ltd. vs. Siby George (2012) 12 SCC 540, the controversy has been set at rest. No. no ground thus, survives to pursue the appeal. In view of above, appeal is hereby dismissed in view of judgment in Siby George's case (supra).
