This is a petition filed under Section 438 Cr.P.C. seeking pre-arrest bail in a case registered against the petitioner vide FIR No. 11 dated 12.01.2015 under Sections 498-A, 406, 506 & 34 IPC at Police Station Urban Estate, Rohtak.

Learned State counsel, on instructions from ASI Udham Singh, who is present in court, at the outset submits that offences under sections 406, 34 IPC have been deleted and petitioner is not required for the purpose of effecting any recovery. However, liberty may be granted to the investigating officer to call the petitioner as and when required.

In view of above, this petition is rendered infructuous and is dismissed as such. However, petitioner shall join investigation as and when required by the investigating officer. This will be subject to the conditions as envisaged under Section 438(2) Cr.P.C.
